    GENERAL TERMS AND CONDITIONS OF SALE

    The following terms and conditions of sale apply to all quotations, contracts or sales invoices issued by O FERROLHO - COMÉRCIO DE FERRAGENS, LDA. All other terms defined by third parties, unless expressly acknowledged in writing by O FERROLHO - COMÉRCIO DE FERRAGENS, LDA, shall be considered invalid. All customers should be fully aware of the conditions of sale. By placing an order, making a purchase or requesting a quotation, you automatically accept the general terms and conditions of sale.

     

    ORDER

    All orders must be placed with O FERROLHO - COMÉRCIO DE FERRAGENS, LDA preferably by email to the contacts provided. Alternatively, you may request it by telephone, go in person to our establishments or to a sales representative, or via the B2B platform.

    By placing the order, you acknowledge that you have been duly informed and accept these general terms and conditions of sale.

     

    PAYMENT TERMS

    Each authorized customer will have a credit limit and a time limit for payment predefined by O FERROLHO - COMÉRCIO DE FERRAGENS, LDA or previously agreed between supplier and customer.

    The payment terms for supplies made by O FERROLHO - COMÉRCIO DE FERRAGENS, LDA are as follows: cheque, cash or bank transfer.

    In the event of a delay in the agreed payment or if an order exceeds the authorized credit limit, O FERROLHO - COMÉRCIO DE FERRAGENS, LDA reserves the right to suspend supplies, as well as to change other previously agreed conditions.

    All goods are considered the property of O FERROLHO - COMÉRCIO DE FERRAGENS, LDA until full payment has been made.

     

    PRICES

    The prices charged by O FERROLHO - COMÉRCIO DE FERRAGENS, LDA are listed in a price table and are subject to change without prior notice. All prices should be regarded as indicative, and the final prices must be confirmed with O Ferrolho in order to avoid errors and inconvenience for the customer. In the case of quotations, these are valid for 8 days as indicated in the document. VAT at the legal rate in force for transactions in the national market is added to the prices.

     

    TRANSPORT

    O FERROLHO - COMÉRCIO DE FERRAGENS, LDA usually uses the carriers SKYNET, RODISLOG and ROTA ALTERNATIVA. For all orders with a value of less than €400 (net), the transport cost is calculated according to the weight of the goods and the shipping distance.

    The goods are deemed to have been delivered in good condition, complete and without visible damage upon the recipient’s signature. Otherwise, the customer must indicate acceptance with reservation on the transport document.

    Any problem with the delivery of the goods must be reported in writing to the email address comercial@oferrolho.pt within 48 hours and must be indicated on the carrier’s delivery note that accompanies the shipment.

     

    DELIVERY TIMES

    O FERROLHO - COMÉRCIO DE FERRAGENS, LDA undertakes to inform its customers about delivery lead times whenever requested, before the order is placed, by email or telephone using the contacts provided.

    Delivery times are always merely indicative and are subject to change, without prior notice, due to force majeure.

    In the event of failure to meet the expected delivery time, our company does not accept any kind of claim for compensation related to the delay in supply.

    If the expected delivery time is extended by more than two weeks, we reserve the right to inform the customer of this and give them the option to cancel the order or replace the product with a similar one.

    When transport is arranged by O FERROLHO - COMÉRCIO DE FERRAGENS, LDA, the customer undertakes, at the time of order confirmation, to provide O FERROLHO - COMÉRCIO DE FERRAGENS, LDA with all the information necessary for the delivery of the goods, such as the unloading location, conditions and physical means available at the unloading location, and legal requirements for the transport and packaging of goods. It is the customer’s responsibility to provide and ensure, at the time of unloading, the physical and human resources necessary at the respective location.

     

    SPECIAL ORDERS

    All requests for special products must be submitted in writing, will be quoted in advance and will only be valid on condition that there are no cancellations or returns. Special products are understood to be those that result in purpose-made production following the customer’s instructions, according to dimensions, quantities, finishes, combinations, packaging, brands or other specifications carried out specifically on request.

    O FERROLHO - COMÉRCIO DE FERRAGENS, LDA reserves the right to request an advance payment for the production of these products as a way of confirming the order.

    Returns of special or made-to-measure product orders will not be accepted.

     

    COMPLAINT / RETURN

    Any complaint regarding the goods received must be communicated to O FERROLHO - COMÉRCIO DE FERRAGENS, LDA by email to marketing@oferrolho.pt within 4 days after receipt of the order and must be accompanied by proof-of-receipt documents and visual evidence (e.g. photographs).

    Any non-conformity (item, quantity or quality) must be communicated to us within 24 hours of receipt. Professional customers may also do so via the B2B platform.

    In the case of a complaint relating to manufacturing defects that can only be detected during use, application or assembly, the above period is extended to 15 days consecutive from the date of receipt of the goods or, in situations where transport is provided (Delivery Note or Transport Guide).

    Until O FERROLHO - COMÉRCIO DE FERRAGENS, LDA informs the customer of the acceptance of the complaint, the goods must remain in the customer’s possession. If the complaint is accepted, the goods must be returned within a maximum period of 15 working days from the communication of this fact to the customer, under penalty of expiry, unless otherwise agreed between the two parties.

    In situations where the customer returns the goods without authorization from O FERROLHO - COMÉRCIO DE FERRAGENS, LDA, any costs arising therefrom shall be borne by the customer, namely shipping, transport or packaging costs.

    O FERROLHO - COMÉRCIO DE FERRAGENS, LDA is not liable for damage/failures in the goods resulting from handling and/or storage on the customer’s premises or during transport arranged by the customer.

    O FERROLHO - COMÉRCIO DE FERRAGENS, LDA reserves the right not to accept any type of complaint submitted by the customer, unless all of the aforementioned provisions have been complied with.

     

    RETURN

    Returns are not accepted without prior consent from O FERROLHO - COMÉRCIO DE FERRAGENS, LDA.

    Any return of goods will only be accepted when accompanied by the original packaging, a duplicate delivery note on which the invoices relating to the sale of the goods must be mentioned, and a copy of the document proving acceptance by O FERROLHO - COMÉRCIO DE FERRAGENS, LDA.

    It is the customer’s responsibility to return the product in perfect condition and properly packaged.

    If the handling carried out to inspect the nature, characteristics and functioning of the product exceeds the handling that is normally admissible in the establishment, the customer will be held responsible for the depreciation of the product.


    WARRANTY OF CONSUMER GOODS AND AFTER-SALES SERVICE

    As O FERROLHO - COMÉRCIO DE FERRAGENS, LDA is not the manufacturer of any product, all conformity warranty is provided through the manufacturers of the respective products.

    All equipment sold at www.oferrolho.pt is covered by a conformity warranty for goods corresponding to a period of 2 years from the date of delivery, and the customer must keep proof-of-purchase documents for evidentiary purposes. Failure to present proof of purchase excludes O FERROLHO - COMÉRCIO DE FERRAGENS, LDA from any liability.

    The consumer must notify the seller of the lack of conformity within a period of two months from the date on which it was detected.

    The warranty does not cover cases in which the damage resulted from improper or abusive use, poor installation, inappropriate use, transport damage, intervention by non-specialized technicians, painting or finishing applied to materials, use of unsuitable chemical products, or lack of regular maintenance.

    The conformity warranty will only be valid after verification and detection of an existing defect by certified technicians duly authorized by the product manufacturer. Any repairs carried out without the written consent of the manufacturer or O Ferrolho will be the responsibility of the customer and will automatically be excluded from any warranty.

    In the event of a lack of conformity of the goods with the contract, the consumer has the right to have the situation remedied free of charge (without unnecessary expenses to bring the goods into conformity with the contract) by means of repair or replacement, an appropriate reduction of the price or termination of the contract. Repair or replacement shall be carried out within a period of 30 days.

    Where the good is replaced, the replacement good benefits from a warranty period of two years from the date of delivery.

     

    PERSONAL DATA

    Any personal data provided by the customer and contained in this invoice will be deemed necessary for the performance of the contractual relationship and will be processed by O FERROLHO - COMÉRCIO DE FERRAGENS, LDA in accordance with the provisions of the Privacy Policy available at www.oferrolho.pt

     

    JURISDICTION

    For any and all disputes, the Judicial Court of the District of Braga shall have jurisdiction, to the exclusion of any other.

     

    AMENDMENTS

    Any changes to these terms of sale shall only be valid if accepted in writing by O FERROLHO - COMÉRCIO DE FERRAGENS, LDA.

     

    CHANGES TO THE TERMS OF SALE

    O Ferrolho may modify these conditions at any time but may not, under any circumstances, apply them retroactively.
